1. Introduction

Welcome to the General Terms and Conditions of Qoyawarkuna Travel. This document establishes the rights and obligations of our Agency and the Client regarding the contracting, payment, and execution of any of our tourism services (tours, packages, and transfers) in Peru. By confirming a booking with Qoyawarkuna Travel, the Client declares having read, understood, and fully accepted the clauses stipulated herein. These T&C form the legal basis of our service contract and are subject to Peruvian tourism and consumer protection laws.

2. Complete Content (Key Legal Clauses)

2.1 Responsibility of Qoyawarkuna Travel

Qoyawarkuna Travel acts as an intermediary between the Client and local service providers (transport, accommodation, guides, train operators, etc.). The Agency is responsible for the correct management, organization, and confirmation of contracted services. However, Qoyawarkuna Travel does not assume responsibility for:

  • Damage, loss, delays, or injuries caused by the negligent actions or omissions of third parties not directly controlled (suppliers).
  • Events of force majeure, casus fortuitus (unforeseeable circumstances), or causes beyond our control, such as airport or road closures, strikes, social conflicts, natural disasters, or government decisions.
  • Additional expenses incurred by the Client due to the events described in the preceding point.

2.2 Client Obligations and Declarations

The Client is obligated to:

  • Information: Provide complete and accurate personal information (legal names, dates of birth, passport numbers) at the time of booking.
  • Documentation: Hold a valid passport (minimum validity of six months) and necessary visas/permits to enter and travel within Peru.
  • Health and Fitness: Declare that they possess the appropriate physical condition and health to participate in the contracted tour (especially for high-altitude treks such as Salkantay, the Inca Trail, or Choquequirao).
  • Insurance: Purchase and maintain valid Travel Insurance covering medical assistance, repatriation, baggage loss, and, preferably, trip cancellation.

2.3 Prices, Payments, and Adjustments

All prices are confirmed at the time of booking. Qoyawarkuna Travel requires payment of an initial deposit (variable amount depending on the tour) to secure services. Full payment of the balance must be made before the deadline specified on the voucher. The Agency reserves the right to adjust prices not fully paid only if there are government-imposed changes (taxes, fees) or if final suppliers apply significant increases. The Client assumes any bank charges or fees for international transactions.

2.4 Cancellations and Modifications

Specific policies regarding cancellations, penalties, and modifications are detailed in our Booking and Cancellation Policy, which the Client declares having read and accepted. The Client acknowledges and accepts that entrance tickets (e.g., Machu Picchu), train tickets, and trekking permits are non-refundable once issued, and any modification may generate additional fees.

2.5 Jurisdiction and Applicable Law

Any dispute, controversy, or claim arising out of or related to the provision of services or the interpretation of these Terms and Conditions will be resolved in accordance with the Laws of the Republic of Peru. Both parties submit to the jurisdiction of the competent courts of the city of Cusco, waiving any other jurisdiction that may correspond to them.

3. Includes (Scope of the T&C)

  • Clear definition of the responsibilities and limitations of Qoyawarkuna Travel.
  • Emphasis on the mandatory nature of travel insurance for the Client.
  • Clause regarding price validity.
  • Declaration of submission to Peruvian laws.

4. Excludes (Coverage Exclusions)

  • Responsibility for the Client’s failure to obtain necessary visas or documentation.
  • Coverage of the Client’s personal or medical risks (must be covered by travel insurance).
  • Reimbursement for services the Client voluntarily does not use.

5. Recommendations (Legal Warning)

  • Data Verification: Review and confirm that all your personal data is identical to that on your passport before confirming the booking.
  • Travel Insurance: Purchase a comprehensive insurance policy immediately after making the deposit.
  • Communication: In case of emergency or itinerary change during the trip, immediately contact the emergency contact number provided by Qoyawarkuna Travel.
