1. Introduction and Legal Framework

Qoyawarkuna Travel firmly adheres to and commits to the Code of Conduct Against the Sexual Exploitation of Children and Adolescents (ESNNA) in the field of tourism, in accordance with the guidelines of the Ministry of Foreign Trade and Tourism (MINCETUR) and the General Tourism Law (Law No. 29408).

Our Agency denounces and condemns any form of ESNNA and considers it a serious violation of human rights and a criminal offense. This Code of Conduct is mandatory for our legal representatives, directors, employees, guides, drivers, and contracted suppliers.

2. Our Commitment and Zero Tolerance Policy

2.1 Statement of Principles

Qoyawarkuna Travel establishes a ZERO TOLERANCE policy against any act of sexual exploitation, abuse, harassment, or utilization of minors (under 18 years of age) within the scope of our tourism services or on our premises.

2.2 Prohibited Actions

All personnel, suppliers, and clients of Qoyawarkuna Travel are strictly prohibited from:

• Promoting, facilitating, or tolerating any act that favors ESNNA, including child prostitution or sex tourism.
• Offering, explicitly or implicitly, in any promotional material or tour plan, activities related to the sexual exploitation of minors.
• Guiding tourists to establishments or locations where the commercial sexual exploitation of children and adolescents is practiced.
• Using the Agency’s facilities or contracted services (vehicles, hotels) for the purposes of sexual exploitation.

3. Prevention and Awareness Measures

3.1 Towards Staff and Suppliers

• Training: Continuous awareness and training for all our staff on the prevention, detection, and reporting of ESNNA.
• Contracts: Inclusion of clauses in contracts with our suppliers (hotels, transport, guides) obligating them to adhere to and comply with this Code of Conduct.
• Monitoring: Vigilance over compliance with the Code of Conduct at all our contact points and services.

3.2 Towards the Client

• Information: Informing our Clients, before and during the trip, about the existence of Peruvian regulations that impose criminal penalties for the sexual exploitation and abuse of minors, even if the crime is committed by a foreign citizen.
• Awareness: Promoting responsible and conscious tourism that protects the integrity of Peruvian children and adolescents.

4. Reporting and Legal Cooperation

4.1 Reporting Channels

Qoyawarkuna Travel encourages immediate reporting and commits to cooperating with authorities. Any person (staff, client, or supplier) who becomes aware of a suspicious or actual case of ESNNA must report it immediately to the following entities:

• Peruvian National Police (PNP): Toll-free line.
• Public Ministry (Ministerio Público): Authority responsible for the prosecution of the crime.
• Line 100: Free orientation and reporting service from the Ministry of Women and Vulnerable Populations (MIMP).
• Qoyawarkuna Travel Emergency Contact (24/7).

4.2 Internal and Legal Sanctions

Non-compliance with this Code by personnel or suppliers will result in immediate contract termination, in addition to corresponding legal actions before Peruvian authorities.

5. Includes (The Explicit Commitment)

• The declaration of Zero Tolerance and the explicit condemnation of ESNNA.
• Qoyawarkuna Travel’s commitment to the General Tourism Law.
• Mandatory clause for all staff and suppliers.

6. Excludes (Exclusions)

• Legal responsibility for the crime. The agency’s role is prevention and reporting; the prosecution of the crime is the jurisdiction of Peruvian authorities.
• Provisions regarding other professional or general tourism codes of ethics (this is a specific code against ESNNA).

7. Recommendations (Warning to Clients)

• Immediate Action: Do not hesitate to use the official reporting channels (Police or Line 100) at any indication of exploitation.
• Criminal Consequences: Remember that the abuse and sexual exploitation of minors are serious crimes in Peru, penalized with prison sentences, regardless of the offender’s nationality.
